EEOC Revises Covid-19 Testing Guidance for Employers

Throughout the Covid-19 Pandemic, the EEOC has provided guidance about many employment related issues involving Covid-19. On July 12, 2022, the EEOC again revised its guidance regarding mandatory Covid-19 testing.


Now, employers will need to assess pandemic and workplace circumstances in order to justify mandatory Covid-19 testing of employees. Employers must show that the coronavirus testing is job-related and consistent with business necessity as defined by the Americans with Disabilities Act.


Before this updated guidance, Covid-19 testing was permitted without any required justification or assessment. The EEOC has provided several factors to consider when making this assessment.
